These Terms apply to customers and general users who access or use Fleetly’s website, marketplace, account features, saved vehicles, search tools, enquiry tools, booking request tools, and related customer services. By creating an account, saving a vehicle, submitting an enquiry, clicking Request to book, or otherwise using Fleetly, you agree to these Terms. If you do not agree, you must not use Fleetly.
Fleetly operates an online marketplace that helps customers discover, compare, save, and connect with commercial vehicle suppliers in New Zealand. Fleetly may provide search, enquiry, booking request, saved vehicle, account, and marketplace support tools. Unless Fleetly expressly states otherwise in writing, Fleetly is not the owner, operator, driver, hirer, maintainer, insurer, or supplier of vehicles listed on the platform.
Fleetly helps introduce customers to independent suppliers. Vehicle hire, rental, lease, transport, delivery, or related service arrangements are generally between you and the relevant supplier. Suppliers are responsible for their vehicles, pricing, availability, booking approval, insurance, safety, suitability, legal compliance, delivery, collection, deposits, bonds, cancellation terms, and hire conditions. A booking is not confirmed until the supplier confirms it under their own process.
You may need an account to save vehicles, submit enquiries, or use certain features. You must provide accurate, complete, and current information. You are responsible for keeping your login details secure. Fleetly may restrict, suspend, or close your account if we reasonably believe there has been misuse, fraud, security risk, false information, unlawful conduct, or breach of these Terms.
Fleetly may require email verification before you can access certain account, saved vehicle, enquiry, or booking request features. If verification is required, you must verify your email address using the process provided.
You must use Fleetly only for lawful purposes, submit genuine enquiries only, provide accurate contact, booking, location, date, and vehicle requirement information, ensure the vehicle requested is suitable for your intended use, check supplier terms before confirming any booking, and comply with supplier licence, age, payment, deposit, bond, insurance, operating, delivery, collection, and cancellation requirements.
When you click Request to book, save a vehicle, or submit an enquiry, Fleetly may create an enquiry record and share relevant information with the supplier so they can respond. This may include your name, company, email, phone, requested vehicle, requested dates, pickup or service location, enquiry details, and account activity needed to support the marketplace.
Fleetly may display prices, availability, locations, vehicle details, features, images, supplier information, and marketplace labels. Supplier-entered rates may be used to calculate a price for selected dates, while custom-quote listings remain enquire-for-pricing. Final payment, fees, deposits, bonds, insurance excesses, delivery charges, cancellation charges, fuel charges, cleaning charges, damage charges, and other hire-related costs are set or confirmed by the supplier unless Fleetly expressly states otherwise.
Unless Fleetly expressly provides payment processing, payments are handled directly between you and the supplier. Fleetly is not responsible for supplier payment collection, deposits, bonds, refunds, damage charges, insurance excesses, cancellations, or disputes unless Fleetly expressly agrees in writing to assist.
You are responsible for ensuring the requested vehicle is suitable for your intended use. This includes vehicle size, payload, licence class, driver eligibility, load type, towing requirements, refrigeration or temperature needs, route restrictions, insurance conditions, health and safety requirements, and legal operating requirements. Fleetly does not provide transport, loading, engineering, legal, insurance, or compliance advice.
Suppliers may have their own terms, contracts, conditions, payment requirements, cancellation policies, insurance terms, driver requirements, or operating rules. You should review and accept the relevant supplier’s terms before confirming a booking.
Saved vehicles do not reserve or hold availability. A saved vehicle may later become unavailable, change price, be removed, or be updated by the supplier or Fleetly.
Fleetly may show labels such as verified, featured, trusted, popular, or similar. These labels help marketplace navigation and quality control. They are not a guarantee that a supplier or vehicle is suitable for every customer, use, route, load, or booking.
Fleetly may link to supplier websites, booking pages, maps, payment tools, or other third-party services. Fleetly is not responsible for third-party websites, content, security, pricing, terms, availability, or actions. You use third-party websites and supplier booking pages at your own risk.
Fleetly aims to provide a reliable service but does not guarantee uninterrupted access. The platform may be unavailable, delayed, or interrupted due to maintenance, upgrades, outages, security events, third-party provider issues, or circumstances outside Fleetly’s control.
Fleetly owns or licenses the Fleetly brand, platform, design, layout, software, text, marketplace structure, and related intellectual property. You must not copy, reproduce, scrape, resell, reverse engineer, or commercially exploit Fleetly content or systems without written permission.
You must not use Fleetly unlawfully, submit fake enquiries, impersonate another person or business, harvest supplier or customer data, attempt to bypass login, security, rate limits, or marketplace controls, interfere with platform availability, upload harmful code, misuse supplier contact information, or use Fleetly in a way that harms Fleetly, customers, suppliers, or marketplace integrity.
Fleetly handles personal information in accordance with its Privacy Policy. By using Fleetly, you acknowledge that your information may be collected, used, stored, and shared as described in the Privacy Policy.
Fleetly may send service-related communications about your account, saved vehicles, enquiries, booking requests, security, support, platform updates, or supplier responses. Marketing communications will be handled in accordance with applicable law.
Nothing in these Terms limits rights that cannot legally be excluded under New Zealand law. If you use Fleetly for business purposes, you agree that, to the maximum extent permitted by law, any consumer protections that may be lawfully excluded for business-to-business transactions are excluded.
To the maximum extent permitted by law, Fleetly is not liable for supplier vehicles, supplier conduct, supplier terms, vehicle availability, vehicle condition, booking approval, hire disputes, accidents, delays, cancellations, damage, loss, supplier charges, indirect loss, loss of profit, loss of opportunity, loss of data, business interruption, or reputational loss. Fleetly’s total liability arising from or relating to the platform is limited to the amount you paid directly to Fleetly for the relevant service, or NZD $100 if you paid nothing directly to Fleetly. Nothing in these Terms excludes liability where exclusion is not permitted by law.
You agree to indemnify Fleetly against claims, losses, costs, damages, liabilities, and expenses arising from your breach of these Terms, inaccurate or unlawful information you provide, misuse of Fleetly, dealings with suppliers, breach of law, or breach of third-party rights.
Fleetly may update these Terms from time to time. Updated Terms apply from the date published unless stated otherwise. Continued use of Fleetly after changes means you accept the updated Terms.
These Terms are governed by the laws of New Zealand. Disputes relating to Fleetly or these Terms are subject to the non-exclusive jurisdiction of the New Zealand courts.
